The Regulatory Backlash: Three Systems on Collision Course

On December 11, 2025, President Trump signed an executive order that casts doubt on the enforceability of state AI laws, proposing to establish a uniform Federal policy framework for AI that preempts state AI laws deemed to be inconsistent with that policy. [1]

But rather than achieving "uniform" regulation, the executive order has triggered something closer to regulatory warfare.

The Executive Order directs the Attorney General to establish an AI litigation task force to challenge state AI laws deemed inconsistent with the Executive Order's language, including on the grounds of unconstitutional regulation of interstate commerce and federal preemption. California's Countermove: Sovereignty Through Procurement

The response came swiftly. While the federal government dismantles contracting standards and removes basic protections for Americans, Governor Gavin Newsom today issued an executive order to explore stronger AI standards for state procurement, with the order aiming to ensure that companies meet strong standards and demonstrate responsible policies that prevent misuse of their technology, while protecting users' safety and privacy. This happened on March 30, 2026—just weeks into the Trump administration's legal offensive. California's move is tactically brilliant: by tightening procurement requirements, the state bypasses federal preemption arguments. The Executive Order does identify categories of regulation that are not proposed for preemption, including regulation of child safety, AI compute and data center infrastructure (except for generally applicable permitting reforms), and state government procurement and use of AI. In other words, California found the carve-outs and is operating directly within them.

The EU's Enforcement Machine: August 2, 2026

While Washington and Sacramento spar over federalism, Europe is moving past debate into enforcement. August 2, 2026 marks when full enforcement activates with penalties up to €35M or 7% global revenue, and organizations must prepare for August 2026 enforcement. [5]

This is the "Brussels Effect" in real time: The enforcement of the EU AI Act is the latest example of the "Brussels Effect," where EU regulations effectively become global standards because it is more efficient for multinational corporations to maintain a single compliance framework, with companies like Adobe and OpenAI integrating C2PA watermarking into their products worldwide, not just for European users. August 2, 2026: The big one—High-risk system requirements become enforceable, which is when police facial recognition rules, employment AI restrictions, and biometric identification requirements all land. [9]

What Tech Companies Should Actually Do

Most are aligning with the strictest standard, typically the EU AI Act, to simplify compliance, with cross-border governance teams coordinating legal, technical, and ethical oversight to stay ahead of diverse requirements. [13]

This is the rational economic choice. The EU AI Act has moved beyond legislation into active implementation and enforcement, with GPAI oversight, enforcement infrastructure, and high-risk system compliance deadlines approaching, and organizations that proactively implement governance, documentation, and risk management systems will be positioned to compete successfully in regulated AI markets, while those who delay compliance will face legal, operational, and market access risks. While Trump fights state laws and calls for deregulation, the EU is shipping enforcement infrastructure. Many countries are rightly being cautious and assessing risks, but more coherence is needed in policymaking, and nations should work together to design policies that not only enable development, but also incorporate guardrails. Instead, we're getting the opposite: regulatory fragmentation across the world's three largest digital markets. Tech companies will end up complying with the strictest regime anyway. The real losers? Startups without global compliance teams, and the myth of a free, deregulated AI market.

The regulatory fracture isn't being healed. It's deepening.
